Nutrifactants, LLC, doing business as Planet Earth Agronomy ("Planet Earth Agronomy," "PEA," "we," "us," or "our"), respects your privacy. This Privacy Policy explains what information we collect when you visit planetearthagronomy.com (the "Site"), apply to become a member or dealer, contact us, or subscribe to our communications, and how we use, share, and protect that information.

We are an agricultural inputs company serving growers, dealers, distributors, and agronomists across the United States. We sell through a dealer and agronomist network; we do not sell products directly to consumers through this Site, and we do not process online payments on this Site.

INFORMATION we collect 

Information you give us directly. When you submit a form, apply for membership or a dealer/distributor account, request information, sign up for our newsletter, or otherwise contact us, we may collect:

  • Name (first and last)

  • Email address

  • Phone number

  • Company or operation name

  • Job title or role

  • State and territory / service area

  • Business type (e.g., grower, dealer, distributor, agronomist)

  • Whether you are interested in becoming a dealer or distributor

  • Any message, comment, or other details you choose to provide
     

Member account information. If you create a member account or join our community area, we collect your login credentials and profile details, and we keep a record of the resources and content you access through your membership tier.

Testimonials. If you provide a testimonial, we may publish your name, your state, and the products you reference, with your permission.

Information collected automatically. When you visit the Site, our website platform and analytics tools may automatically collect technical and usage data, including your IP address, device and browser type, pages viewed, links clicked, referring website, and the dates and times of your visits. Some of this is collected through cookies and similar technologies (see "Cookies and Tracking Technologies" below).

We do not intentionally collect sensitive personal information (such as Social Security numbers, government IDs, financial account numbers, health data, or precise geolocation) through this Site.

How do we use this information

We use the information we collect to:

  • Respond to your inquiries and provide the information, products, or services you request;

  • Review and process membership and dealer/distributor applications and manage member accounts;

  • Connect you with the appropriate regional agronomist, dealer, or team member;

  • Send you newsletters, product updates, field-trial results, and other communications you have asked to receive, or that relate to an existing business relationship;

  • Operate, maintain, secure, and improve the Site and our services;

  • Understand how visitors use the Site so we can make it more useful;

  • Comply with our legal obligations and enforce our terms; and

  • Protect the rights, property, and safety of Planet Earth Agronomy, our users, and others.

How we share your information

We do not sell your personal information. We share it only in these limited circumstances:

  • Service providers. We use trusted third parties to operate our business — for example, our website and hosting platform (Wix.com), and our email, analytics, and form/CRM tools. These providers process information on our behalf and are permitted to use it only to provide services to us. (See "Third-party platforms and links" below for the key providers.)

  • Within our network. To fulfill your request, we may pass your enquiry to the relevant Planet Earth Agronomy team member, regional agronomist, or authorised dealer/distributor.

  • Legal and safety reasons. We may disclose information if required by law, subpoena, or other legal process, or where we believe disclosure is necessary to protect rights, property, or safety.

  • Business transfers. If Nutrifactants, LLC is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.

  • With your consent. We may share information in other ways with your direct permission.

Email communications AND your choices

If you receive marketing emails from us (such as our newsletter or product announcements), every message includes a clear way to unsubscribe and our physical mailing address. You can opt out of marketing emails at any time by using the unsubscribe link or by contacting us at the email address in "Your privacy rights" below; we will honor your request promptly. We may still send you non-marketing messages related to an active membership, application, or transaction (for example, account or service notices).

Cookies and tracking technologies

The Site uses cookies and similar technologies to function properly, remember your preferences, keep member sessions secure, and help us understand Site usage. Cookies may be set by us or by our service providers.

You can control cookies through your browser settings and, where available, through the cookie banner or preferences tool on the Site. Disabling some cookies may affect how parts of the Site work. Where we use analytics or advertising technologies that respond to browser-based opt-out signals (such as Global Privacy Control), we honor those signals where applicable.

Third-party platforms and links

Our Site is built and hosted on Wix, which collects and processes certain visitor data to provide and secure the Site; Wix's own privacy practices are described in its privacy policy at wix.com. We also use Google Analytics and Meta (Facebook) advertising tools to measure Site performance and to deliver and measure advertising.

The Site may link to third-party websites and social platforms (including our Instagram, Facebook, LinkedIn, and YouTube pages). We are not responsible for the privacy practices or content of those third parties; we encourage you to review their privacy policies.

Your privacy rights

Depending on where you live, you may have rights under applicable US state privacy laws. As a matter of practice, we extend the following choices to all of our users, regardless of state:

  • Access — request a copy of the personal information we hold about you;

  • Correction — ask us to fix inaccurate information;

  • Deletion — ask us to delete your personal information;

  • Opt-out — unsubscribe from marketing communications; and

  • Non-discrimination — we will not deny you service or treat you differently for exercising these rights.
     

To make a request, contact us at the email address in "Who we are" above. We may need to verify your identity before acting, and we will respond within the timeframe required by applicable law (generally within 45 days). You may use an authorized agent to submit a request on your behalf, subject to verification.

Residents of states with comprehensive privacy laws (such as California, Colorado, Virginia, and others) may have additional specific rights; we will honor those rights as required where the law applies to us.

Data retention

We keep personal information for as long as needed to provide our services, manage your membership or relationship with us, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

Data Security

We use reasonable administrative, technical, and physical safeguards — including those provided by our hosting platform — to protect personal information. No method of transmission or storage over the internet is completely secure, however, and we cannot guarantee absolute security.

Children's privacy

The Site is intended for agricultural professionals and is not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, please contact us and we will delete it.

Out-of-state and international site visitors

We are based in the United States and operate the Site from the US. Our service providers, including Wix, may process and store data on servers located in other regions. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with local laws

Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect means you accept the updated policy.
